General Terms and Conditions – TARIFF REGULATIONS

Tarifverbund Lungau Katschberg Obertauern

Valid from 30/09/2025

1. General and scope of Services

Tarifverbund Lungau Katschberg (Seekarstraße 2, A-5562 Obertauern) provides its services to customers exclusively on the basis of these General Terms and Conditions (GTC). These are binding and apply to all current and future business transactions with Tarifverbund Lungau Katschberg Obertauern. Deviating GTC are not accepted. The individual services for which this pass entitles the holder are provided independently and under their own responsibility by legally separate companies: Gebrüder Krings Bergbahnen GmbH, Steiner GmbH & Co KG, Tauernlift GmbH, Obertauern Seilbahngesellschaft m.b.H. & Co KG, Schaidberg Sesselbahn Gesellschaft m.b.H. & Co. K.G., Schaidberg Sesselbahn Gesellschaft m.b.H. & Co. K.G. Verbindungssessellift KG, Sonnenlifte Obertauern Gesellschaft m.b.H., Schönalmbahn Betriebs GmbH, Alpenhotel Perner GmbH & Co KG, Hundsfeldlift GmbH, Kehrkopf Seilbahn GmbH, Bergbahnen Lungau GmbH & Co KG, Fanningbergbahnen GmbH & Co KG, Katschbergbahnen GmbH, Skilift Lessach, Skilift Zederhaus, Skilifte Schönfeld, and Skilifte Krakau. The entrepreneur selling the pass acts only as a representative for the other entrepreneurs. Any liability or warranty for incidents arising from or during the operation and use of cable car and lift facilities as well as slopes lies exclusively with the company in whose (ski) area the incident occurred. There is no liability on the part of the remaining cable car or lift companies. The tariff regulations of the Tarifverbund Lungau Katschberg Obertauern apply, and in the ski areas the conditions of carriage of the individual cable car companies.

2. Conclusion of Contract for Online Purchases

2.1 The customer’s online order requires complete and correct entry of all mandatory fields in the booking window and express acceptance of the GTC using the application provided in the booking window. False information may lead to revocation of entitlement without compensation and to exclusion from carriage. The Obertauern Winter Card can only be booked with a current photo. The customer is obliged to notify any changes to their contact details (name, residential address, email address) without delay. After entering the data and clicking the payment button, this legally constitutes an offer to conclude a purchase contract for the respective Obertauern ski pass. Acceptance of the purchase offer is expressly reserved. There is no obligation to accept the customer’s offer. The customer will receive, within a few minutes at the address provided, an email which may constitute acceptance of the purchase offer, provided that a customer who is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG) has a right of withdrawal for online orders.

Tarifverbund Lungau Katschberg Obertauern is entitled to cancel orders and bookings at any time if the customer violates the contractual terms or attempts to circumvent them.

It is expressly pointed out that not all ski passes can be booked in the online shop.

2.2 Right of revocation
If the customer is a consumer within the meaning of the Consumer Protection Act, the customer has the right to withdraw from this contract within 14 days without giving reasons.

The withdrawal period is fourteen days from the day the contract is concluded.
To exercise the right of withdrawal, the customer must inform the shop owner (Tarifverbund Lungau Katschberg Obertauern, Seekarstraße 2, 5562 Obertauern, www.lungo.at, onlineshop@ski-obertauern.at) of the decision to withdraw from this contract by means of a clear statement (e.g. by email or by a letter sent by post).
We provide a cancellation form for this purpose: Cancellation Form
Tarifverbund Lungau Katschberg Obertauern will reimburse the payments made by the customer no later than 14 days after receipt of the withdrawal notice. The same means of payment used by the customer in the original transaction will be used for the refund. No fees will be charged for the refund.
If the customer wishes to book an online ticket which entitles them to use lift facilities and slopes during a period that begins before the expiry of the 14-day withdrawal period, the customer must expressly declare this request for early contract performance pursuant to § 10 FAGG (Distance and Off-Premises Contracts Act). The right of withdrawal does not exist if all purchased (service) benefits have already been provided within the withdrawal period. If (service) benefits purchased have been partially provided before the withdrawal notice is asserted, the refund claim will be reduced proportionately.
If the customer is an entrepreneur, withdrawal is entirely excluded.

2.3 The services covered by the Obertauern ski pass can be used after purchase of the respective ski pass within the corresponding period of validity and after the facilities of the providing cable car and lift companies (see Section 1) have been put into operation. If a customer does not make use of the purchased service for reasons attributable to their sphere, although the companies of Tarifverbund Lungau Katschberg Obertauern were ready to perform, this does not affect the contract and does not release the customer from the payment obligation.

2.4 Vouchers in the Online Shop
Print@Home value vouchers are sold in the online shop. These can be printed out directly after purchase or sent by email to a third person. The customer is solely responsible for providing the correct email address.
Please note that Print@Home vouchers are assigned a unique voucher code. If several vouchers with the same voucher code appear, this constitutes misuse with criminal consequences.
If, due to incorrect information provided by the customer, there is a delay in delivery, delivery to the wrong email address, or non-delivery, Tarifverbund Lungau Katschberg Obertauern assumes no responsibility in this regard.
Value vouchers are transferable.
Print@Home vouchers can be redeemed exclusively at the lift ticket offices in Obertauern or in the web shop of Tarifverbund Lungau Katschberg Obertauern and entitle the holder only to purchase ski passes.
If the value of the vouchers exceeds the service used, the remaining amount can be redeemed with the next purchase. A cash payout of a credit balance or of an outstanding remaining amount is not possible. Upon redemption, the business and conditions of carriage of the individual cable car and lift companies apply. The value of the voucher is determined solely by the amount paid for the voucher. If a dedication has been made on the voucher by the contracting partner, this is not binding.

2.5 Booking Processing
For the technical and financial processing of bookings in the web shop, Tarifverbund Lungau Katschberg Obertauern uses various partners directly or indirectly (Skidata AG, Skiperformance AS, Hobex AG). These companies do not enter into a direct contractual relationship with the customer unless such a relationship already exists due to other legal circumstances. In the course of the booking process, you may be redirected to websites of these companies, for whose content the respective company is responsible. Please also observe their general terms and conditions in connection with payment processing.

3. Prices and Payment Options

Our prices are quoted in euros and include the statutory VAT valid in Austria (10% VAT).

Price changes are subject to possible VAT increases. Payment options for ski passes are in accordance with the payment terms of the individual ski areas. In the event of overlapping season dates, mixed prices are calculated by the ticket office systems. Ski passes are issued exclusively on keycards (contactless data carriers). The deposit fee for a keycard is between EUR 2 and EUR 5 depending on the ski area. Subsequent exchange of already used ski passes for a different ski pass, transfer to other persons, extension or postponement of the validity period is not possible. Unused ski passes purchased in another ski area are also excluded from exchange.

For a lost or damaged LUNGO Winter Card or a LUNGO 10-day choice pass, a new LUNGO Winter Card or LUNGO 10-day choice pass can be issued for a processing fee of EUR 15 (plus keycard deposit). Re-issuance requires presentation of the blocking receipt and an official photo ID. If the LUNGO Winter Card has already been used on the day the loss is reported, the validity period of the newly issued LUNGO Winter Card is limited to the days following that day.

4. Use of Services

For the use of ski pass services, these GTC and the conditions of carriage of the respective cable car and lift companies apply; these are posted on site.

The official regulations and measures in connection with pandemics (e.g. COVID-19) and other official measures also apply.
Provided that the companies of the ski areas of the Tarifverbund Lungau Katschberg Obertauern are ready to perform and the lift facilities in operation allow the use of the corresponding slopes, the customer has no right of withdrawal in the event of bad weather, avalanche risk, the customer’s unforeseen early departure, temporary interruptions of operation, weather-related shutdowns of individual facilities, closures of individual ski runs, partial operation of a ski area, overcrowding of slopes, and illness of the ticket holder. In these cases there is no entitlement to a refund and the customer is not released from the payment obligation.

The LUNGO Winter Card entitles the holder to use, on 15 days between 15 December 2024 and 15 April 2025, the facilities that are in operation on the day of use. The lift operating companies (members) of the Tarifverbund Lungau Katschberg Obertauern voluntarily agree—until revoked—to allow eligible holders of the LUNGO Winter Card to use the facilities outside the aforementioned period and for more than 15 days. Actual use of the LUNGO Winter Card lies within the customer’s sphere, provided lift and cable car facilities are in operation. There is therefore no entitlement to a refund if fewer than 15 days are used.

It is expressly stated that no (pro-rata) refund can be claimed if cable car companies of the Tarifverbund Lungau Katschberg Obertauern are ready to perform but the user does not make use of these services for personal reasons/decisions; therefore, if official measures are ordered for the use of the services of the cable car companies (e.g. obligation to present a negative test certificate, proof of vaccination, etc.) and the user cannot or does not wish to provide such proof, no claim to a (pro-rata) refund can be made.

It is further stated that compliance with the officially prescribed COVID-19 or other protective measures to contain a pandemic is the sole responsibility of the user. If the user cannot or does not wish to comply with officially prescribed measures, carriage may not take place and no claim to a (pro-rata) refund can be made.

Likewise, there is no entitlement to a (pro-rata) refund or extension of the ski pass if cable car companies shut down individual or several lift facilities due to officially ordered restrictive measures as a result of low user frequency, as the user still has the possibility to use the majority of the services offered.

The conditions of carriage posted at all valley stations form part of the contract of carriage. They apply (in accordance with statutory provisions) to the transport of persons as well as to their conduct in the railway area. The contracting party is obliged to comply with the conditions of carriage. A violation of the conditions of carriage has consequences under liability law. The rules of conduct of the International Ski Federation (FIS) apply without restriction. Reckless conduct or other serious violations of these rules of conduct or of the general tariff provisions and conditions of carriage will result in revocation of entitlement without compensation and exclusion from carriage and may be reported to the authorities where appropriate. The assertion of any claims for damages by Tarifverbund Lungau Katschberg Obertauern and/or the other cable car or lift companies remains unaffected.

5. Refunds in the Event of Official Closures

If the participating cable car and lift companies are prevented from providing services in the Tarifverbund Lungau Katschberg Obertauern with all lifts and cable car facilities due to an epidemic or pandemic or other official regulations (e.g. energy control measures) and this results in a complete closure of operations of the affected cable car and lift companies for a period of at least 4 weeks from the date of purchase of a Lungo Winter Card, the costs paid by the customer for the Lungo Winter Card will be refunded for the period of complete closure as follows:

  • For Lungo multi-day ski passes on the basis of the actual possible use (example: if closure occurs after the 3rd day of validity of a 6-day ski pass, the customer will be refunded the difference between the purchase price of a 3-day ski pass and the purchase price paid for the 6-day ski pass).
  • For a Lungo 10-day choice pass, the unused days of the choice pass will be refunded on a pro-rata basis.
  • For the Lungo Winter Card, the refund is based on an amortisation calculation, whereby it is determined whether the costs of the Lungo Winter Card have already amortised through the customer’s use. This is the case if the card has been used on 15 days or more. The calculation of the amount to be deducted from the purchase price is therefore made by dividing the purchase price by 15 (days) and multiplying by the number of days used (commercial rounding to EUR 0.50).

A refund is therefore excluded in any case if the customer has already used the Lungo Winter Card on 15 days or more. If a Lungo Winter Card is purchased during a lockdown or thereafter, the customer has no claim to a refund for the duration of the ongoing or already expired lockdown. The refund claim can be asserted with the Tarifverbund Lungau Katschberg Obertauern at the earliest at the end of the season.

6. Refunds Only in the Event of Accident or Injury

Attention – deposit the card immediately! Refunds are possible only from the time of deposit and upon presentation of a medical certificate from a local doctor. Day tickets already used cannot be refunded. For refunds, the tariff for the time used is generally deducted. Unused days that do not fall within the period of injury will not be refunded. A refund for Lungo Winter Cards after 28 February of a calendar year is excluded.
For a LUNGO Winter Card, the refund is based on an amortisation calculation, whereby it is determined whether the costs of the LUNGO Winter Card have already amortised through the customer’s use. This is the case if the card has been used on 15 days or more. The amount to be deducted from the purchase price is calculated by dividing the purchase price by 15 (days) and multiplying by the number of days used (commercial rounding to EUR 0.50). A refund is therefore excluded if the customer has already used the LUNGO Winter Card on 15 days or more. If a LUNGO Winter Card is purchased during a lockdown or thereafter, the customer has no claim to a refund for the duration of the ongoing or already expired lockdown.

A refund for LUNGO Winter Cards after 28 February of a calendar year is excluded.

No refund or extension in the event of bad weather, interruption of operations, avalanche danger, closed ski runs, early departure, illness, failure of individual lift or cable car facilities, or officially ordered closure of operations!
No replacement in case of loss, theft, or forgotten ski pass. Subsequent exchange or change of the validity period of a ski pass entitlement is not possible.

7. Misuse

Upon request, the ski pass must be shown to cable car personnel or control staff and handed over for the duration of the inspection. If data inspection is refused, the data carrier may be blocked for the winter season at all facilities within the valid ski pool. If guests are found in the control zone without a ski pass or with an invalid ski pass, damages will be charged. Misused ski passes will be confiscated without compensation and will result in exclusion from carriage. According to our tariff regulations, persons who misuse ski passes are subject, in addition to purchasing a day ticket, to a handling surcharge of EUR 50 or an administrative penalty of EUR 250. Lungo Winter Cards are linked to a specific person and cannot be transferred or resold to other persons. In the event of misuse, the ski pass will be withdrawn and exclusion from carriage will follow. Attempting to unlawfully transfer a ski pass to another guest already constitutes misuse. Therefore, please use only the ski pass issued to you personally!

Holders of Lungo Winter Cards are obliged to keep their own Lungo Winter Card in such a way that other persons cannot use it.
The provisions regarding school and youth groups are indicated accordingly in our price lists. The age of children, adolescents, and also youth groups must be proven with a photo ID upon request both when purchasing the ski pass and at lift access points.
The inspectors deployed in the ski areas and the cable car personnel are entitled to perform all official acts corresponding to their functions at all slopes, lift and cable car facilities.

For ski passes with a validity of more than 8 days, a photo is required. The photo is captured digitally at our points of sale and is visible when passing the access system at the lift. Ski passes requiring a photo that have no photo or an invalid photo will be confiscated without compensation and will be invalid for the remainder of the winter season.

The grounds for receiving a discounted ski pass must also be presented upon request during access checks at the cable car stations.

By purchasing the ski pass, the purchaser undertakes to observe and comply with the applicable tariff and conditions of carriage.
The sale of ski passes or ski passes with a specific validity period may be suspended if safety on the ski slopes can no longer be guaranteed due to overcrowding.
The ski pass must be kept in such a way that misuse by third parties is excluded. In the event of misuse, the Tarifverbund Lungau Katschberg Obertauern reserves the right to file a criminal complaint. The assertion of any claims for damages by the Tarifverbund Lungau Katschberg Obertauern and the other cable car or lift companies remains unaffected.

8. Information pursuant to Articles 13 and 14 GDPR on “Photocompare”

For the purpose of access control and to prevent misuse of lift tickets as well as to ensure compliance with tariff conditions, a reference photo of the lift ticket holder is taken when passing through a turnstile equipped with a camera for the first time on the basis of our legitimate interests pursuant to Article 6(1)(f) GDPR. This reference photo is compared by lift staff with the photos taken each time the person subsequently passes through a camera-equipped turnstile. No automated image data matching takes place. The reference photo is deleted immediately after the lift ticket expires; the other photos (control photos) are deleted no later than 30 minutes after each passage through a turnstile. Only in individual cases (if our employee has doubts regarding the match between the control photo and the reference photo) is the automatic deletion of the control photo prevented. For the purpose of clarifying a criminal offense or enforcing civil claims, we are, in individual cases, entitled—where necessary to enforce our claims (Article 6(1)(f) GDPR, Article 10 GDPR in conjunction with § 149 Austrian Criminal Code “obtaining services by fraud”)—to transmit your master data and information relating to the incident to security authorities, courts, insurers, and lawyers. If the suspicion of unlawful use of the ski ticket is not substantiated, the control photo is deleted immediately. In connection with access control through Photocompare, we also process your name, address, date of birth, and the number and type of ski pass. All data is stored in encrypted form. In addition, solely for settlement purposes with other lift operators, we process the times and locations of access of the lift ticket pursuant to Article 6(1)(b) GDPR. For this purpose, the data is stored for 3 years. The (image) data from the Photocompare system is not used to create any kind of movement profiles of lift ticket users. No audio recordings are made. Please note that our lift tickets are non-transferable. Photocompare is not used at all lift facilities in the ski area, but only at certain designated entry points. We point out that it is also possible to purchase lift tickets that are technically configured so that no photo is taken when passing through the turnstile; however, random checks by lift staff must then be expected. We use Skidata AG, Untersbergstraße 40, 5083 Gröding/Salzburg, as a processor.

9. Data Protection and Data Subject Rights

Protecting our customers’ personal data is of particular concern to the cable car and lift companies. Further information on data protection and data subject rights can be found in the privacy policy of the Tarifverbund Lungau Katschberg Obertauern, available at https://www.lungo.at/kontakt/datenschutzbedingungen

10. Liability

The Tarifverbund Lungau Katschberg Obertauern is not liable for damages suffered by a customer as a result of the conduct of third parties. The use of unmarked ski slopes (“open terrain/off-piste”) is at the user’s own responsibility and risk. No safety or marking measures (such as protective measures, inspections, closures, etc.) are carried out in open terrain. Any measures taken in exceptional cases are voluntary and do not create any obligation on the part of the Tarifverbund Lungau Katschberg Obertauern.

11. Choice of Law and Jurisdiction

The contractual relationship between Tarifverbund Lungau Katschberg Obertauern and the customer is governed by the law of the Republic of Austria. The application of the UN Convention on Contracts for the International Sale of Goods and the conflict-of-laws rules of private international law is excluded. The exclusive place of jurisdiction for all disputes arising from or in connection with the concluded contract and these GTC is the court with subject-matter jurisdiction at the registered office of the respective defendant company.

If the customer is a consumer within the meaning of the KSchG, the competent court for any legal disputes is the court in whose district the consumer has their domicile, habitual residence, or place of employment. If the customer is a consumer with habitual residence in the EU, they may bring an action either before the court with subject-matter jurisdiction at the registered office of the respective defendant company or before the court of the place where the consumer has their domicile.
Should any provision of these GTC be invalid, a provision shall be deemed agreed which comes closest to the original provision. The remaining provisions of the GTC remain effective.
