The entrepreneur who sells the card acts for the other entrepreneurs only as their Intermediary. Only the respective company is therefore obliged to provide the individual services and to pay compensation in the event of any incidents.

The tariff regulations of the tariff association Tarifverbund Lungau Katschberg Obertauern and, in the ski areas, the transport conditions of the individual cable car companies apply.

2. Costs and payment options

All prices are quoted in EUR incl. 10% VAT. Prices are subject to change due to a possible VAT increase. Subject to any increase in VAT. Payment options for ski passes according to the payment conditions of the individual ski resorts. In the event of overlapping season dates, mixed prices will be calculated by the ticket office computers.

Ski passes are issued exclusively on keycards (contactless data carriers). The deposit fee for a keycard is between EUR 2,- and EUR 5,- depending on the ski resort. Return of undamaged and functional keycards with Lungo ski pass authorisation at all ski pass sales points in the Lungo ski areas. Subsequent exchange of already used ski passes for another ski pass, transfer to other persons, extension or postponement of the validity period is not possible. Unused ski passes purchased in another ski resort are also excluded from exchange.

A lost or damaged LUNGO Winter-Card or 10-day selective subscription pass can be replaced with a new LUNGO Winter-Card or 10-day selective subscription pass for a €15 administration fee (plus the keycard deposit). Confirmation that the keycard has been blocked and an acceptable photographic ID are needed before a new pass can be issued. If the LUNGO Winter-Card has already been used on the day on which the loss is notified, the remaining period of validity of the new LUNGO Winter-Card starts on the following day.

3. Use of the services

The use of the ski pass services is subject to these General Terms and Conditions and the conditions of carriage of the respective cableway and lift companies; these are displayed on site.

Furthermore, the officially prescribed regulations and measures in connection with pandemics (e.g. COVID-19) as well as other officially prescribed measures apply.

Provided that the companies of the ski areas of the Lungau Katschberg Obertauern tariff association are ready to provide services and the lifts in operation permit use of the corresponding slopes, the customer has no right of cancellation in the event of bad weather, avalanche danger, unforeseen departure of the customer, temporary interruptions of operations, weather-related suspension of operations of individual lifts, closure of individual ski runs, partial operation of a ski area, overcrowding of slopes and illness of the ticket holder. There is therefore no entitlement to a refund in these cases and the customer is not released from their payment obligation.

The LUNGO Winter Card entitles the holder to use the lifts in operation on the day of use for 15 days between 15 December 2022 and 15 April 2023. However, the members of the LUNGO tariff association voluntarily agree - until revoked - to allow entitled holders of the LUNGO Winter Card to use the lifts outside the aforementioned period and beyond 15 days. The actual use of the LUNGO Winter Card is the responsibility of the customer, provided that the partners of the LUNGO tariff association have their lifts in operation. Accordingly, there is no entitlement to a refund if the card is used for less than 15 days.

It is expressly stated that no (proportional) refund can be claimed if the cableway companies of the Lungau Katschberg Obertauern tariff association are willing to provide services, but the user does not make use of these services due to personal considerations/decisions; should therefore e.g. official measures are ordered for the use of the services of the cableway companies (e.g. obligation to present a negative test certificate, proof of vaccination, etc.) and if the user is unable or unwilling to provide this proof, no claim to a (pro rata) refund can be asserted.

It is also noted that compliance with the COVID-19 or other protective measures prescribed by the authorities to contain a pandemic is the sole responsibility of the user. Should the user be unable or unwilling to comply with measures prescribed by the authorities, his carriage may not take place and no claim to a (pro rata) refund may be asserted. Similarly, there is no entitlement to a (pro rata) refund or extension of the ski pass if cableway companies take individual or several lifts out of operation due to officially imposed restriction measures on account of low user frequency, as the user is nevertheless able to make use of the majority of the services offered.

4. Reimbursement in the event of official closures of operations

If the participating cableway and lift companies with all their lifts and cableway installations are prevented from providing services in the Lungau Katschberg Obertauern tariff association due to an epidemic or pandemic or other official regulations (e.g. energy control measures), the customer shall be entitled to the Lungo Winter Card. If the Lungo Winter-Card is prevented from operating due to an epidemic or pandemic or other official regulations (e.g. energy control measures) and this results in a complete closure of the affected cable car and lift companies for a period of at least 4 weeks from the date of purchase of a Lungo Winter-Card, the costs paid by the customer for the Lungo Winter-Card for the period of the complete closure will be refunded as follows:

- in the case of Lungo multi-day ski passes, on the basis of the actual possible use (example: if closure occurs after the 3rd day of validity of a 6-day ski pass, the customer will be refunded the difference between the purchase price for a 3-day ski pass and the purchase price paid by him/her for the 6-day ski pass);

- in the case of a Lungo 10-day optional subscription, the customer will be refunded on a pro rata basis for the days of the optional subscription not consumed;

- in the case of the Lungo Winter Card, the refund is made on the basis of an amortisation calculation, whereby it is determined in each case whether the costs of the Lungo Winter Card have already been amortised by the customer's use. This is the case if the card has been used on 15 or more days. The calculation is therefore made by dividing the purchase price by 15 (days) and multiplying by the number of unused days.

A refund is thus excluded in any case if the customer has already used the Lungo Winter Card on 15 or more ski days. If a Lungo Winter Card is purchased during or after a lockdown, the customer is not entitled to a refund for the period of the current or already expired lockdown. The refund claim can be asserted with the Tarifverbund Lungau Katschberg Obertauern, at the earliest at the end of the season.

5. Refund only in case of accident - injury!

Attention - deposit card immediately! Refunds are only possible from the time of deposit on presentation of a medical certificate from a local doctor. Day tickets that have already been used can no longer be refunded. For refunds, the tariff for the time used will generally be deducted. Unused days which do not fall within the period of injury will not be reimbursed. A refund for Lungo Winter Cards after 28.02. of a calendar year is excluded.

No refund or extension in the event of bad weather, interruption of operations, avalanche danger, closed ski runs, early departure, illness, failure of individual lift or cable car facilities or closure of operations ordered by the authorities!

In the case of a LUNGO Winter Card, reimbursement is based on an amortisation calculation, whereby it is determined in each case whether the costs of the LUNGO Winter Card have already been amortised by the customer's use. This is the case if the card has been used on 15 or more days. The calculation is therefore made by dividing the purchase price by 14 (days) and multiplying by the number of unused days.
A refund is therefore excluded in any case if the customer has already used the LUNGO Winter Card on 15 or more ski days.

No replacement in case of loss or forgotten ski pass.

6. Abuse

Upon request, the data carrier must be presented to the cableway personnel or the control body and handed over for the duration of the control. In case of refusal to inspect the data, the data carrier can be blocked for the winter season at all lifts within the valid ski pool. If guests are found in the control zone without a ski pass or with an invalid ski pass, damages will be charged. Misused ski passes will be confiscated without replacement. According to our tariff regulations, persons with incorrectly used ski passes are liable to a surcharge of EUR 50,- or an administrative fine of EUR 250,- in addition to the additional purchase of the day pass. Lungo Winter Cards are bound to a specific person and cannot be transferred or resold to other persons. In the event of misuse, the ski pass will be withdrawn, charges will be brought before the court and a claim for damages will be made. Therefore, please only use the ski pass issued to you personally!

Holders of Lungo Winter Cards are obliged to store their own Lungo Winter Card in such a way that other persons cannot use this Lungo Winter Card.

The provisions regarding school and youth groups are referred to accordingly in our price lists. The age of children, young people and youth groups must be proven on request with a photo ID when purchasing a ski pass or accessing the lifts. The ticket inspectors and cable car personnel employed in the ski areas are authorised to carry out all their official duties on all slopes, lifts and cable cars.

A photo is required for ski passes valid for more than 8 days. The photo is digitally recorded at our sales points and can be seen when passing through the access system at the lift. Ski passes requiring a photo without or with an invalid photo will be confiscated without replacement and will lose their validity for the rest of the winter season.

The justification for obtaining a reduced ski pass must also be presented on request at access controls at the cable car stations. By purchasing the ski pass, the purchaser undertakes to observe and comply with the applicable tariff and transport conditions. The sale of ski passes or ski passes with a specific period of validity may be discontinued if safety on ski slopes is no longer guaranteed due to overcrowding.

The ski pass must be kept in such a way that misuse by third parties is also excluded. The right to file a criminal complaint is expressly reserved.

7. Information pursuant to § 24 DSG 2000 on "Photocompare"

Please note that for the purpose of access control, a reference photo of the lift card holder is taken the first time the lift card holder passes through a turnstile equipped with a camera. This reference photo will be compared by the lift staff with the photos taken each time the lift card holder passes through a turnstile equipped with a camera. The reference photo will be deleted immediately after the expiry of the lift ticket, the other photos at the latest 30 minutes after the respective passage through a turnstile. Please note that it is also possible to purchase lift tickets that are technically configured in such a way that no photo is taken when passing through the turnstile, but that random checks by the lift staff must be expected. Transport will take place after an access control has been carried out. The location and number of accesses are stored exclusively for billing purposes and insofar as this is necessary for the fulfilment of the contract.

Photo registration/data protection: With the purchase of a name-based ski pass (Lungo Winter-Card/Wahlabo), the cardholder agrees to an automatic registration of personal data. The customer agrees that this data may be computerised, processed and deleted as soon as it is no longer required, but no later than three years after the last customer contact, for control purposes to prevent misuse of the card and for the purpose of customer care. The customer can be informed by e-mail/letter about new services and ski offers. This service is free of charge and can be cancelled at any time. With the purchase of a ski pass, the cardholder agrees to a personal photographic recording, storage and processing at the card issuing and access points for control purposes to prevent misuse of the card, whereby this data is deleted upon expiry of the validity period of the ski pass if the card is used in accordance with the contract.

8. Data protection

The protection of our customers personal data is of particular concern to the cable car and lift companies. Customer data is therefore processed exclusively on the basis of the legal provisions (in particular DSGVO and DSG). Reference is made to the privacy policy of the Tarifverbund Lungau Katschberg Obertauern, which is published on our website.

9. Choice of law and place of jurisdiction

Substantive Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the reference standards of international private law.

If the customer is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), the court in whose district the customer's place of residence, habitual abode or place of employment is located shall have jurisdiction over any legal disputes. If the customer is a consumer with habitual residence in the EU, he may choose to bring an action before the competent court in Salzburg or before the court in the place where the consumer has his residence.

In all other cases, the court with subject-matter jurisdiction at the registered office of the respective defendant company shall be agreed.

Cancellation of reductions, errors, typesetting and printing errors reserved.
